Man arrested after found passed out

A man is facing multiple drug charges after officers allegedly found him passed out behind the wheel of his vehicle.

Donald Buell, 48, of Wallins, was arrested by Harlan City Police Department officers on May 2.

According to the citation, Buell was allegedly reported to the police for being passed out in his vehicle, and an officer observed Buell with his foot on the brake while the car was running.

After being awakened by an officer, Buell reportedly displayed symptoms of slurred speech and unsteadiness.

The citation states, officers asked permission to search his vehicle, which Buell granted. They allegedly found a white pill bottle containing different types of pills. Officers also located what they thought to be a large rock of methamphetamine and a metal case under the driver’s seat, containing a large baggie of what appeared to be methamphetamine, Buprenorphine strips and more pills.

Buell was given 15 minutes to contact a lawyer but failed to do so. Buell also refused to comply with requested testing.

Buell was charged with first-degree trafficking controlled substance (second offense or greater; greater than or equal to 2 grams of methamphetamine), second-degree trafficking controlled substance (second offense or greater; drug unspecified), third-degree trafficking controlled substance (first offense; drug unspecified), improper parking violations, operation of motor vehicle while under the influence of drugs/alcohol, operation of vehicle on expired operator’s license, no registration receipt, no registration plates, failure of non-owner operator to maintain required insurance, failure to wear seat belts, tampering with physical evidence and possession of drug paraphernalia.

He was lodged in the Harlan County Detention Center with no bond set.

He was charged as a persistent felony offender with two counts first-degree possession of controlled substance (methamphetamine), second-degree possession of controlled substance (drug unspecified), possession of drug paraphernalia, second-degree fleeing/evading police (on foot) and contempt of court. He was lodged in the Harlan County Detention Center on a $3,500 full-cash bond with bail credit and $7,000 bond, 10 percent with bail credit;

• Jeremy Franks, 39, of Cumberland, was arrested by Cumberland Police Department officers on April 28. He was charged with theft by unlawful taking (more than $500 but under $10,000). He was lodged in the Harlan County Detention Center on a $1,000 full-cash bond;

• Flossie Cleaver, 36, of Cawood, was arrested by Harlan City Police Department officers on April 28. She was charged with first-degree possession of controlled substance (methamphetamine), second-degree possession of controlled substance (drug unspecified), possession of drug paraphernalia and contempt of court. She was lodged in the Harlan County Detention Center on a $3,000 full-cash bond with bail credit;

• Mark Wynn, 29, of Closplint, was arrested by Harlan County Sheriff Office deputies on April 29. He was charged with first-, second- and third-degree possession of controlled substance (drug unspecified), possession of drug paraphernalia and flagrant non-support. He was lodged in the Harlan County Detention Center on a $500 full-cash bond and $10,000 bond, 10 percent with bail credit;

• Deborah Maiden, 46, of Dayhoit, was arrested by Harlan City Police Department officers on April 30. She was charged with first-degree possession of controlled substance (methamphetamine), operation of motor vehicle while under the influence of drugs/alcohol, registration/title requirements for vehicle non-operational on highway, failure to produce insurance card, failure of non-owner operator to maintain required operator’s license, no registration plates, no registration receipts, failure to/improper signal and three counts failure to appear. She was lodged in the Harlan County Detention Center on a $7,000 bond, 10 percent with bail credit;

• Mary Bargo, 30, of Gulston, was arrested by Loyall Police Department officers on May 1. She was charged with third-degree possession of controlled substance, possession of drug paraphernalia, endangering the welfare of a minor, tampering with physical evidence and three counts failure to appear. She was lodged in the Harlan County Detention Center on a $3,500 full-cash bond and $250 full-cash bond;

• Lyndon Sweatt, of Harlan, was arrested by Harlan City Police Department officers on May 1. He was charged with third-degree burglary and possession of marijuana. He was lodged in the Harlan County Detention Center on a $10,000 bond, 10 percent with bail credit;

• Melissa Taylor, 40, of Wallins, was arrested by Harlan City Police Department officers on May 1. She was charged with first-degree possession of controlled substance (methamphetamine), first-degree promoting contraband, driving on a suspended license (DUI), no registration receipt, no registration plates, failure to produce insurance card, failure of owner to maintain required insurance, no operator’s license, failure to notify address change to the department of transportation, improper display of registration plates, improper equipment and three counts failure to appear. She was lodged in the Harlan County Detention Center on two $100 full-cash bonds;

• Jessica Smith, 32, of Benham, was arrested by Cumberland Police Department officers on May 2. She was charged with second-degree trafficking controlled substance. She was lodged in the Harlan County Detention Center with no bond set;

• Barbara Skidmore, 30, of Wallins, was arrested by Loyall Police Department officers on May 2. She was charged with four counts first-degree promoting contraband, second-degree possession of controlled substance (drug unspecified), two counts third-degree possession of controlled substance (drug unspecified), illegal possession of legend drug and prescription controlled substance without proper container. She was lodged in the Harlan County Detention Center with no bond set;

• Joe McKinney, 44, of Slemp, was arrested by Harlan County Sheriff’s Office deputies on May 2. He was charged as a persistent felony offender II with flagrant non-support and contempt of court. He was lodged in the Harlan County Detention Center on a $1,000 surety bond;

• Jason Gilbert, 30, of Harlan, was arrested by Harlan County Sheriff’s Office deputies on May 2. He was charged as a persistent felony offender II with first-degree trafficking controlled substance (second offense or greater; greater than or equal to 2 grams methamphetamine), possession of drug paraphernalia, failure to wear seat belts, operating on suspended/revoked operator’s license, no operator’s license and failure of non-owner operator to maintain required insurance. He was lodged in the Harlan County Detention Center with no bond set.
