Preliminary hearing on March 9 for Totz murder

After a Totz man was killed in a shooting on the morning of Feb. 15, the man arrested for the murder has been brought back to Harlan County and now awaits a preliminary hearing on March 9.

Richard G. Cody, 59, of Harlan, was arrested by Kentucky State Police troopers on Feb. 15 after he allegedly entered his estranged wife’s home and fired multiple rounds, killing Matthew Smith, 39.

Smith was pronounced dead at Harlan ARH shortly after the incident, while Cody fled to Washington County, Tenn., where he was arrested and taken in custody. Cody was then extradited back to Kentucky and lodged in the Harlan County Detention Center on Feb. 25.

Cody was charged with murder and first-degree wanton endangerment and was lodged in the Harlan County Detention Center on a $250,000 full-cash bond. He was scheduled for an arraignment on Friday and will follow up with a preliminary hearing on March 9 at 1 p.m. in the Harlan County Circuit Court.

Another unrelated event left one Putney man behind bars and approximately 14.5 grams of methamphetamine removed from the streets.

Adam Teague, 32, was arrested by Harlan Police Department chief Winston “Wink” Yeary and officers Mitch Alford and Derrick Noe on Feb. 27.

According to police, they received information from Smok’n Joe’s about a vehicle that Teague was occupying. Teague was known to have multiple warrants in Kentucky, and upon searching him, Alford found 14.5 grams of methamphetamine and $250 in cash.

Teague allegedly admitted the drugs were his during questioning. Alford was then assisted in the arrest by Yeary and Noe. Teague was then transported to the Harlan County Detention Center by officer Anthony Jenkins.

Teague was charged with first-degree trafficking controlled substance (more than 2 grams methamphetamine), three counts contempt of court, two counts failure to appear and non-payment of court costs/fees/fines. His bond is set at three pay-or-stay totals of $1,104.50.

The allegations of drug trafficking are part of an ongoing investigation conducted by Harlan Police Department officers.

In other police activity:

• Donnie Gilbert, 25, of Cawood, was arrested by Kentucky State Police troopers on Feb. 21. He was charged with first-degree possession of controlled substance (methamphetamine), possession of drug paraphernalia, non-payment of court costs/fees/fines, probation violation, operation of motor vehicle while under the influence, prescription controlled substance without proper container, third-degree trafficking controlled substance, operating on suspended/revoked operator’s license, failure to owner to maintain required insurance, failure to produce insurance card, no registration receipt, no registration plates and improper display of registration plates. He was lodged in the Harlan County Detention Center on three full-cash bonds totaling $16,000 and $270 in time served with jail credit;

• John Gray, 32, of Flat Lick, was arrested by Kentucky State Police troopers on Feb. 22. He was charged as a persistent felony offender I with theft by unlawful taking (between $500 and $10,000), operation of motor vehicle while under the influence, operating on suspended/revoked operator’s license, failure of owner to maintain required insurance, failure to produce insurance card, registration and title requirements for vehicle not operational on highway, no registration plates, no registration receipt, improper equipment and rear license not illuminated. He was lodged in the Harlan County Detention Center on two full-cash bonds totaling $6,000;

• Jason Shepherd, 38, of Cumberland, was arrested by Cumberland Police Department officers on Feb. 24. He was charged as a persistent felony offender II with first-degree possession of controlled substance (methamphetamine), second-degree criminal trespassing, theft by unlawful taking (between $500 and $10,000) and two counts failure to appear. He was lodged in the Harlan County Detention Center on two full-cash bonds totaling $6,000;

• Tina Asher, 51, of Loyall, was arrested by Loyall Police Department officers on Feb. 25. She was charged with first-degree trafficking controlled substance (more than 2 grams methamphetamine) and first-degree criminal possession of a forged instrument. She was lodged in the Harlan County Detention Center on a $1,500 full-cash bond;

• Vickie Farmer, 64, of Loyall, was arrested by Loyall Police Department officers on Feb. 25. She was charged with second-degree trafficking controlled substance and was lodged in the Harlan County Detention Center on a $1,500 full-cash bond;

• Stevie Prather, 57, of Loyall, was arrested by Loyall Police Department officers on Feb. 25. He was charged with first-degree trafficking controlled substance (more than 2 grams methamphetamine) and was lodged in the Harlan County Detention Center on a $2,500 full-cash bond;

• Vickie Hoskins, 62, of Baxter, was arrested by Loyall Police Department officers on Feb. 25. She was charged with second-degree trafficking controlled substance, third-degree possession of controlled substance (drug unspecified) and possession of drug paraphernalia. She was lodged in the Harlan County Detention Center on a $2,500 full-cash bond;

• Stephanie Brock, 46, of Loveland, Ohio, was arrested by Harlan County Sheriff’s Office deputies on Feb. 25. She was charged with first-degree assault and was lodged into the Harlan County Detention Center;

• Brandon Trammell, 33, of Evarts, was arrested by Evarts Police Department officers on Feb. 26. He was charged with third-degree criminal trespassing, third-degree criminal mischief, third-degree burglary, first-degree possession of controlled substance (methamphetamine) and possession of drug paraphernalia. He was lodged in the Harlan County Detention Center on a $5,000 full-cash bond;

• Clayton Napier, 50, of Evarts, was arrested by Harlan County Detention Center officers on Feb. 27. He was charged with first-degree possession of controlled substance (methamphetamine) and possession of drug paraphernalia. He was lodged in the Harlan County Detention Center on a $3,500 full-cash bond;

• Denver Simpson, 41, of Wallins, was arrested by Kentucky State Police troopers on Feb. 28. He was charged with first-degree possession of controlled substance (methamphetamine), second-degree possession of controlled substance (drug unspecified), possession of drug paraphernalia and failure to appear. He was lodged in the Harlan County Detention Center.
