One man was arrested and another was sent to the hospital after a confrontation in Kildav ended in gunfire.

Jerry Gilbert Jr., 46, of Kildav, was arrested by Kentucky State Police troopers on Feb. 2. According to the citation, KSP Post 10 received a call stating Gilbert had shot his uncle, James Gilbert, in Kildav just before 7 p.m.

Upon their arrival, troopers were notified by Jerry Gilbert and his wife that James Gilbert and another unknown male had allegedly arrived at their residence in a white Chevrolet Malibu and made contact with them at their bedroom window located in the front of the driveway. Jerry Gilbert also notified the troopers the weapons he possessed were placed back into his safe within the residence.

Gilbert’s wife said James Gilbert and the unknown male attempted to pull her through the window while James Gilbert drew a firearm and began shooting into the residence when her husband, Jerry Gilbert, retrieved a 12-gauge shotgun and .22 rifle and returned fire.

Jerry Gilbert told police he was lying in bed when the confrontation began, and after returning fire, the two men attempted to flee to their car when he allegedly chased after them, firing multiple shots into the vehicle. Gilbert also said he was afraid if he didn’t shoot to kill, the men might come back to harm him and his wife.

Gilbert told police he was on several different prescribed medications, as well as taking Xanax he had not been prescribed on that date.

James Gilbert was treated by Lifeguard EMS for serious injuries before he was flown to the Johnson City Medical Center. Gilbert was last said to be in stable condition.

Jerry Gilbert was shown to be a convicted felon and was not allowed to possess a firearm. KSP troopers confiscated both firearms before transporting him to the Harlan County Detention Center, where he was charged with possession of a firearm by a convicted felon and first-degree assault with a $25,000 full-cash bond.

In another unrelated event, a Florida man was arrested by Harlan Police Department officers on Feb. 4 after fleeing the scene of an accident.

According to the citation, Jordan Stevens, 25, of Milton, Florida, was operating a silver colored pick-up truck when he struck another vehicle and fled from the scene. HPD officers were notified by KSP Post 10 dispatch, who told them the caller said the truck had an ATV in the bed and was being operated on only three wheels. A family member of the person operating the vehicle who was struck followed the truck to a local restaurant parking lot.

When HPD officers arrived at the restaurant parking lot, Stevens allegedly told them he was trying to find a place to pull off the road after the accident. After running the license plate numbers from the truck, police learned the vehicle was reported stolen in Florida. The ATV was also found to be stolen out of Lee County, Virginia.

Stevens told police he had no operator’s license. He was read implied consent at Harlan ARH, but refused to submit to tests requested, according to the citation.

He was charged with operation of motor vehicle while under the influence, operating on suspended/revoked operator’s license, leaving the scene of an accident/failure to render aid, reckless driving, two counts receiving stolen property ($10,000 or more) and two counts failure to appear. Stevens was also served with two Kentucky warrants, and was found to be wanted in both Virginia and Florida.

He was lodged in the Harlan County Detention Center with two full-cash bonds totaling $25,000.

• Samantha Jones, 25, of Grays Knob, was arrested by Harlan County Sheriff’s Office deputies on Jan. 30. She was charged with receiving stolen property (under $10,000) and operating on suspended/revoked operator’s license. She was lodged in the Harlan County Detention Center on a $3,500 full-cash bond;

• Dennis Grubbs, 33, of Cawood, was arrested by Harlan County Sheriff’s Office deputies on Feb. 2. He was charged with two counts first-degree unlawful imprisonment and two counts first-degree wanton endangerment. He was lodged in the Harlan County Detention Center on a $3,500 full-cash bond;

• Crystal Burgan, 34, of Cumberland, was arrested by Harlan County Sheriff’s Office deputies on Feb. 2. She was charged with second-degree criminal possession of a forged instrument. She was lodged in the Harlan County Detention Center on a $3,500 full-cash bond;

• Jimmy Howard, 39, of Harrogate, Tenn., was arrested by Kentucky State Police troopers on Feb. 3. He was charged with tampering with physical evidence, possession of drug paraphernalia, first-degree possession of controlled substance (methamphetamine), first-degree promoting contraband, failure to produce insurance card, failure of non-owner operator to maintain required insurance, operating on suspended/revoked operator’s license (DUI) and rear license not illuminated. He was lodged in the Harlan County Detention Center on a $2,500 full-cash bond.
