Calloway man arrested for alleged identity theft

A man from Calloway was arrested on multiple charges, including identity theft, after he allegedly gave Kentucky State Police troopers someone else’s name and an incorrect birth date.

John Rutherford, 49, was arrested by KSP troopers Matthew Barger, Aaron Caldwell, Kevin Howard and Sgt. Jared Boggs on Aug. 10.

According to Barger’s citation, on Friday at approximately 10:40 p.m., he assisted Boggs in a traffic stop on US 119 in Tremont. Barger said he made contact with the passenger while Boggs was talking to Rutherford.

Later during the traffic stop, Barger asked for Rutherford’s driver’s license and proof of insurance, to which Rutherford allegedly told Barger he did not have a valid license but he knew his Social Security number. Rutherford then took out the card and handed it to Barger and told him that his name was Jeffrey Bullins. Rutherford said he did not know his birth date.

Barger said he returned to his vehicle to run the number Rutherford gave him, but the picture did not match Rutherford’s identity. He then asked Rutherford for his birth date again. When Rutherford said he did not know the month or day, only that he was born in the 1970s. Bullins’ birth date, however, is in 1989, according to the citation.

Rutherford allegedly told Barger the truth after he had asked for his name a third time, confirming there were two active warrants for his arrest. Rutherford also advised that a female had exited the car and ran up the hill. Boggs told Barger both subjects were acting nervous when he approached the car and could not give the same story of where they were coming from.

After placing Rutherford under arrest, Barger was able to locate a jewelry box in the backseat floorboard, containing papers from another person named Jeffrey Haywood, according to the citation. Boggs and another trooper were able to locate the female at the residence belonging to Haywood.

The other passenger allegedly gave an open-recording statement of what happened and the plan the female and Rutherford had the whole time.

Caldwell had also advised Rutherford was under the influence at the time of the stop and imposed additional charges.

Rutherford was charged with reckless driving, obstructed vision/windshield, failure to wear seat belts, no registration receipt, failure to produce insurance card, operating on suspended/revoked operator’s license, failure to register/transfer motor vehicle, improper signal, operation of motor vehicle while under the influence of drugs/alcohol, second-degree burglary, giving an officer false identifying information, identity theft and two counts failure to appear.

Rutherford was lodged in the Harlan County Detention Center on four full-cash bonds totaling $4,500.

A case has been opened on both Rutherford and the female involved.

She was charged with first-degree possession of controlled substance (methamphetamine), possession of drug paraphernalia, public intoxication of controlled substance and non-payment of court costs/fees/fines. She was lodged in the Harlan County Detention Center on a $2,500 full-cash bond;

• Mark Cain, 47, of Grays Knob, was arrested by Harlan City Police Department officers on Aug. 6. He was charged with first-degree possession of controlled substance (methamphetamine), second-degree possession of controlled substance (drug unspecified), possession of drug paraphernalia, failure to/improper signal, failure to produce insurance card, operating on suspended/revoked operator’s license and operation of motor vehicle while under the influence of drugs/alcohol. He was lodged in the Harlan County Detention Center on a $2,500 full-cash bond;

• Matthew McElory, 35, of Estill, was arrested by Harlan County Detention Center officials on Aug. 7. He was charged with first-degree possession of controlled substance (methamphetamine). He was lodged in the Harlan County Detention Center with no bond set;

• Charles Cargle, 47, of Lexington, was arrested by Harlan County Detention Center officials on Aug. 8. He was charged with flagrant non-support and contempt of court. He was lodged in the Harlan County Detention Center on a $2,000 full-cash bond with bail credit;

• Amy Adkins, 35, of Harlan, was arrested by Harlan County Sheriff’s Department deputies on Aug. 8. She was charged with first-degree possession of controlled substance (methamphetamine) and possession of drug paraphernalia. She was lodged in the Harlan County Detention Center on an unsecured bond of $1,000;

• Tony Huff, 38, of Closplint, was arrested by Harlan County Sheriff’s Department deputies on Aug. 8. He was charged with first-degree possession of controlled substance (methamphetamine) and tampering with physical evidence. He was lodged in the Harlan County Detention Center on a $5,000 full-cash bond;

• Evelyn Galloway, 52, of Coalgood, was arrested by Kentucky State Police troopers on Aug. 8. She was charged with second-degree burglary and was lodged in the Harlan County Detention Center on a $2,500 full-cash bond;

• Tamara Boggs, 32, of Ages, was arrested by Kentucky State Police troopers on Aug. 9. She was charged as a persistent felony offender II with first-degree possession of controlled substance (methamphetamine), possession of drug paraphernalia and possession of marijuana. She was lodged in the Harlan County Detention Center on a $1,500 full-cash bond, 10 percent with bail credit;

• Tyler Paul, 23, was arrested by Harlan County Detention Center officials on Aug. 9. He was charged with first-degree possession of controlled substance (methamphetamine). He was lodged in the Harlan County Detention Center with no bond set;

• Patricia Couch, 21, of Cumberland, was arrested by Cumberland Police Department officers on Aug. 9. She was charged with first-degree possession of controlled substance (methamphetamine), first-degree wanton endangerment and possession of drug paraphernalia. She was lodged in the Harlan County Detention Center with a $5,000 full-cash bond;

• Adam Banks, 25, of Cumberland, was arrested by Cumberland Police Department officers on Aug. 9. He was charged with first-degree possession of controlled substance (methamphetamine), possession of drug paraphernalia, first-degree wanton endangerment, identity theft, fraud use of a credit card (more than $500 but less than $10,000) and theft by deception (cold checks; under $10,000). He was lodged in the Harlan County Detention Center with two full-cash bonds worth $10,000;

• Clayton Napier, 49, of Evarts, was arrested by Kentucky State Police troopers on Aug. 10. He was charged with first-degree possession of controlled substance (methamphetamine) and possession of drug paraphernalia. He was lodged in the Harlan County Detention Center with a $5,000 full-cash bond;

• Matilda Craig, 35, of Pathfork, was arrested by Kentucky State Police troopers on Aug. 10. She was charged with second-degree burglary and was lodged in the Harlan County Detention Center on a $2,500 full-cash bond;

• Jennifer Hall, 41, of Wallins, was arrested on Aug. 11 for first-degree possession of controlled substance (methamphetamine), third-degree possession of controlled substance (drug unspecified) and possession of drug paraphernalia. She was lodged in the Harlan County Detention Center on a $2,500 full-cash bond;

• Gary Woodsby, 59, of Baxter, was arrested by Harlan City Police Department officers on Aug. 11. He was charged with first-degree possession of controlled substance (methamphetamine) and possession of marijuana. He was lodged in the Harlan County Detention Center with no bond set.
